The California Consumer Privacy Act of 2018 (the “CCPA”) gives California residents certain rights with respect to their personal information, including the rights to access, portability, and deletion, as well as the right to opt out of certain disclosures of personal information. The CCPA also gives California residents the right to stop the “sale” of their personal information through a mechanism called “Do Not Sell My Personal Information.” While we believe that these new legal rights are a positive development, California’s definition of “sale” also captures the disclosure of data between our corporate affiliates (such as Cass Commercial Bank, Cass Europe, B.V., and Cass TEM UK Limited) as well as other disclosures that ordinarily may not be thought of as a “sale.” As we explain at length in our Global Data Privacy Policy, how we share data is a critical component of the services Cass and its affiliates provide. In addition to disclosures to our affiliates, we may disclose your personal information for a business purpose to such third parties as service providers or those to whom you or your agents authorize us to disclose your personal information in connection with services we provide to you. If you are an employee of a Cass customer, your personal information may be disclosed to third parties engaged to perform services for such client and with whom we interface with on such client’s behalf; and, if you are engaged to perform services for one of our clients, your personal information may be disclosed to such client.
